Transparency in the pricing of medicines and in hospital supply contracts

The entry into force in December 2014 of Law 19/2013 on transparency, access to public information and good governance and, more recently in March 2018, of the new Law on Public Sector Contracts has reopened the debate in Spain about the confidentiality of the price of medicines; both the procedures for administrative fixing of the financing price and the result of the negotiated procedures for the public purchase of innovative medicines protected by industrial property rights. This debate has intensified in recent months with the emergence of several Resolutions of the Transparency and Good Government Council related to this sector.
